Ukrainian Law No. 3230-IX introduces the concept of an "active consumer," expanding the opportunities for electricity users. This status can be granted to both residential and non-residential consumers, including municipal institutions, energy cooperatives, and businesses.

Criteria for obtaining active consumer status:

1. Signing an energy supply agreement: Concluding an agreement with the guaranteed buyer or the universal service supplier for the sale of electricity under the “green” tariff, or signing a power purchase agreement under the self-generation mechanism.2. Installation of generating units: Installing energy storage systems to participate in the ancillary services market, provide balancing services, and engage in the purchase and sale of electricity.

Restrictions and loss of status:

A consumer loses active status if the capacity of their generating units exceeds 1 MW and the amount of electricity fed into the grid exceeds 50% of their total consumption.

Technical Implementation Features and Requirements:

  • The installed capacity of the generating unit must not exceed the limit allowed for connection to the power grid.
  • Consumers have the right to connect third-party generating units to their networks, but with power limitations.

Electricity Payment and Supply:

  • The cost of the supplied electricity is credited to the consumer’s personal account in accordance with the retail electricity market rules.
  • The allowed capacity of power installations for supply must not exceed 50% of the consumer’s total network capacity.
